These Terms explain how you may use Moments, what you’re responsible for, and what to expect from the service.
Overview
By using Moments (the app and this website), you agree to these Terms. If you don’t agree, please don’t use the service.
1) Eligibility
You must be allowed to use the service under applicable law. If you are using Moments on behalf of an organization, you represent that you have authority to bind it.
2) Accounts & security
Keep your credentials confidential and use reasonable security measures. You’re responsible for activity under your account. Contact us if you suspect unauthorized use.
3) License & acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable license to use Moments for lawful purposes. You agree not to:
- Reverse engineer, decompile, or attempt to extract source code.
- Bypass security features, access controls, or rate limits.
- Scrape, spam, or abuse the service via automation.
- Use Moments in a way that violates the rights of others or applicable law.
4) Your content
You keep ownership of content you add (such as favorites, notes, diary entries, photos, or uploads). You grant us a limited license to host, store, and process it only to operate and improve Moments and provide requested features.
You are responsible for the content you upload and for ensuring you have the rights to use it (including images used for Moments Studio products).
5) Our service & intellectual property
Moments, including our trademarks, branding, UI, and code, are owned by us (or our licensors). Except for the license above, no rights are granted.
6) Third-party services
Moments may rely on third-party services (for example, maps, search providers, analytics/crash reporting, or payment processors). Their terms and policies apply to those services.
7) Purchases, subscriptions & refunds
Some features may require payment (subscriptions, in-app purchases, or Moments Studio orders). Prices and billing terms are shown at purchase time. Refunds and cancellations are handled according to the storefront or payment provider’s policies, unless required otherwise by law.
8) Availability & changes
We aim to keep Moments available, but uptime is not guaranteed. We may modify, suspend, or discontinue parts of the service, and may update these Terms from time to time. Continued use means you accept updates.
9) Termination
You may stop using Moments at any time. We may suspend or terminate access if you violate these Terms or if required by law.
10) Disclaimers
Moments is provided “as is” and “as available” without warranties of any kind. We don’t guarantee accuracy of third-party data (like places, pricing, availability, or travel information).
11) Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenue, or data.
12) Governing law
These Terms are governed by the laws applicable where you live, unless mandatory law requires a different approach.
